En este artículo presentamos un avance de los procesos de investigación desarrollados en el marco de la tesis doctoral titulada: "Intervenciones sociales, prácticas profesionales en la justicia nacional penal de menores: tensiones emergentes entre el control social y el ejercicio de derechos en tiempos de reforma", cuyo referente empírico esta constituido por una experiencia desarrollada en la ciudad de Buenos Aires y la provincia de igual nombre.En Argentina, en las dos últimas décadas, entró en vigencia una legislación en el fuero de menores/juvenil fundado en la perspectiva denominada de derechos.Nuestras reflexiones se inician a partir de inquietudes desarrolladas por trabajadores sociales, profesionales que son convocados por estas instituciones con miras a desarrollar intervenciones orientadas a restablecer y materializar el acceso a servicios asociados con la perspectiva de derechos en la que se funda el marco legal.Material y métodos: En esta oportunidad, desarrollamos un abordaje cuali cuantitativo, referido a un grupo de jóvenes acusados como infractores con especial consideración a sus trayectorias escolares, dado que en Argentina la educación inicial, primaria y secundaria es considerada obligatoria por ley. Resultados: Esta indagación nos permite considerar distancias entre las condiciones de existencia de la población que transita en el fuero penal juvenil y su efectivo acceso a los derechos prescriptos en la ley.Discusión: Pretendemos llamar la atención sobre determinados aspectos que se visibilizan en los procesos de intervención de los trabajadores sociales en este campo donde el Estado debe proteger antes que a sancionar.In this paper we present a preview of the research process developed within the framework of the doctoral thesis entitled "Social interventions, professional practices in national criminal justice minors: emerging tensions between social control and the exercise of rights in times of reform "whose empirical reference is constituted by an experience developed in the city of Buenos Aires and the province of the same name.In Argentina, in the last two decades, legislation took effect in the jurisdiction of juvenile / youth named based on the perspective of rights.Our thoughts are started from questions developed by social workers, who are called by these institutions in order to develop interventions to restore and materialize the services associated with access rights perspective that is based on the legal framework.Methods: In this opportunity, we developed a quantitative qualitative approach, based on a group of young offenders charged as special consideration to their schooling, as in Argentina primary and secondary education is considered obligatory by law.Results: This research allows us to consider the gap between the living conditions of the population that moves in the criminal youth and their effective access to rights prescribed by law.Discussion: We intend to draw attention to certain aspects that become visible in the processes of intervention of social workers in this field that the state should protect rather than punish
