ALÉM DA CONDENAÇÃO: A AUSÊNCIA DE PRAGMATICIDADE DA AÇÃO CONDENATÓRIA E A BUSCA DA EFICIÊNCIA PROCESSUAL

Resumo: A acao condenatoria representa um elemento que contribui para a ausencia de efetividade do processo. A necessidade de utilizacao de um processo posterior, pelo titular da pretensao, milita contra a celeridade processual. Por outro lado, carrega exclusivamente para o autor o onus processual: o titular de uma pretensao havera de esperar a condenacao para, somente entao, ver iniciada a execucao, capaz de atingir a realidade e de garantir o efetivo papel do direito processual. Abstract: The action chatter represents an element that contributes to the lack of effectiveness of the process. The need to use a process later, by the holder of the claim, militates against the speed of the procedure. On the other hand, loads exclusively to the author the procedural burden: the holder of a claim will have to wait the sentencing to, only then, see started running, capable of achieving the reality and ensure the effective role of procedural law.
