Ferreira, Ibanez and Sampaio (2009) brought out a fundamental issue for all of us interested in games and sports: what kind of relation is there between the stochastic component of play action and the laws that create the games? The relevance of the topic and the arguments of these colleagues leave some room for the discussion and for the analysis of this question from the point of view of the philosophy of Law. In this first part two proposals will be taken into account, apparently alike, to conclude that the only way to define a game based on its intrinsic characteristics is to consider it a legal entity: the first one, Suits' (1967) definition of game-playing, is the canonical one in the field of the philosophy of sport but we have to leave it apart because it does not allow us to effectively distinguish the lusory attitude of the players and the game itself nor saves us from the curse of the tricky triad; the second one, Parlebas' (1988) definition, is a truly operational definition of sporting games that lets us to make classes and corpuses of sporting activities, even though there still are open questions, like the opposition ludo-ergo-motricity, and issues to deeper look into, that will be taken into consideration in the second part.
