La regulacion del sistema de recursos tiene diversas deficiencias mas o menos acusadas, que a nuestro juicio estan relacionadas con dos cuestiones fundamentales. Por una parte, con una marcada caracteristica lagunar de su normativa, registrandose aspectos completos que no reciben regulacion o reciben un tratamiento incompleto o inacabado, y, de otra, con un caracter extremadamente restrictivo y debil (ineficaz) del mismo sistema recursivo en su conjunto y en particular del recurso de nulidad. El presente ensayo se centrara en esta ultima caracteristica, la que se examinara a traves de tres sentencias dictadas por la Ilustrisima Corte de Apelaciones de La Serena.
