La bataille juridique engagee il y a 19 ans entre le groupe electronique allemand Kraftwerk et le producteur Moses Pelham a pris fin, le 31 mai 2016, par une decision adoptee par le Bundesverfassungsgericht (Cour Constitutionnelle de la Republique Federale d’Allemagne). En refusant de reconnaitre au premier des droits d’auteur sur un sample utilise par le second, la Cour a renforce la liberte de creation artistique (article 5 alinea 3 de la Loi Fondamentale) au detriment du droit a la propriete (article 14 de la Loi fondamentale).
