La Constituante cree un systeme judiciaire nouveau. A chaque niveau administratif correspond un tribunal – au canton la justice de paix – dont les juges sont elus par les citoyens. Qui sont ces nouveaux juges desquels on n’exigeait aucune connaissance juridique? Des officiers de l’Ancien Regime, des hommes de loi, des laboureurs, des marchands… Comment ont-ils traverse la periode revolutionnaire? Leur position etait d’autant plus delicate qu’ils etaient elus, comme les politiques, et exercaient souvent des fonctions politiques. Cela ne les a pas empeches de devenir des professionnels de la justice et des notables du Consulat.
