El tema de la gestacion por sustitucion, subrogacion de vientre o maternidad subrogada resulta, para algunos, una de las cuestiones mas nuevas y actuales que presenta el Derecho de las Familias. Sin embargo, luego del analisis que se realizara en este trabajo, se podria concluir que ello no es tan asi.En el presente se plantea, como cuestion principal, si la falta de regulacion por parte del Codigo Civil y Comercial y/o leyes complementarias ha sido obstaculo para que la figura de la gestacion por sustitucion sea utilizada.La respuesta a esa cuestion es negativa. Como se demostrara a lo largo del trabajo, la falta de legislacion no impidio que numerosos casos hayan sido sometidos a decisiones de la justicia nacional, antes y despues de la vigencia del nuevo Codigo Civil y Comercial (en adelante CCC), que hoy innova en la regulacion de las Tecnicas de Reproduccion Humana Asistida (en adelante TRHA), pero no ha incorporado regulacion alguna con respecto a la gestacion por sustitucion. El vacio legal fue cubierto, antes y ahora por la doctrina y, sobre todo, por la jurisprudencia.   The Gestational surrogacy, for some, is a new and current theme in de Family Rights. However, after analyze made this dissertation, we can infer that this inference is wrong.The main question is if lack of regulation in the new Civil and Comercial Code, or in complementary laws, has been an obstacle to use the Gestational surrogacy.The answer in negative. Because lack of regulation did nonstop to many people, who resort to national justice, before and after the new Code. This Code innovates in assisted humans reproduction techniques. However, there are no regulations about the Gestational surrogacy. The void was covered by jurisprudence and doctrinarians.
