This article embarks into the theory of obligations, particularly on what is related to the breach of contract. It analyzes the concept of breach in itself, the damages caused to the Credit law and the causae of damage to the Credit law, which can be generated in different ways, and that modern doctrine has summarized in three formulas: the lateness of execution, the performance of a faulty service and the definite nonfulfill ment of the obligation, the latest also being considered a breach by definition. On these theoretical hypotheses, an analysis of the Cuban civil law of 1989 is performed.
