The purpose of this article is to reflect on civil imprisonment for non-payment of maintenance payments under Brazilian criminal law and the principle of no bis in idem for repeat offenders and the rights the patient has or should have in these cases, thus the problem that surrounds this nucleus to which it brings controversies inherent to the State's punishing power against individuals who find themselves in these situations, as it hurts international agreements and what is described in the Federal Constitution itself in relation to the dignity of the human person and his right to freedom, because according to the principle of no bis in idem, civil imprisonment can occur only once for the crime of default of alimony, and the patient can no longer suffer imprisonment for the same penalty twice, being necessary the restraint of such abusive practice that opposes this principle, prohibiting the so-called double criminality, being necessary to be based on doctrines, since this principle is not described right in the brazilian legal system.
