平成10年 に森林法が一部改正 され,そ の目的は 間伐 の促進,公 益的機能を重視 した森林施業の促 進,市 町村の役割強化であった。公益的機能 を重 視 した森林施業の促 進 とは,長 伐期施業 ・複相林 施業を推進す るための特定森林施業計画において, 小規模森林所有者が共同で計画策定で きるように したこ とであ る。そ して,計 画の対象に天然林 を 追加 し,景 観や多様な生物 の生息空間を形成す る 里山林等 を育成する特 定広葉樹育成施業を追加 し た。市町村の役割強化においては,こ れまで市町 村の森林整備計画は,都 道府県知事が指定 した規 模の大 きい民有林 を有する市 町村 に限 られて立て られて きたのが,全 ての民有林 を有する市 町村が 立てるこ ととなった。 さらに,森 林施業計 画の認 定の権限 を都道府県知事から市町村長へ委譲 した。 本論 では,改 正森林法が現在全国各市町村で樹 立 されている市町村森林整備計画 にどのよ うに活 かす ことがで きるのか,ま た計画 を実効性 あるも のにするための一手段 としての市町村条例等制度 的補完 の有効性等 について,森 林整備 コンクール に推 薦された市町村の事例 での考察 を行 う。
