The notion of “contract” has been discussed in view of the difficulty of assimilating the particularities of employment to a figure created under the parameter of formal equality and autonomy of the contract subjects. The “contractualisation” of workers’ fundamental rights does not seem sufficiently justified, as the rights derive from sources other than the exclusive agreement of wills, while contract reduction may give rise to undesirable consequences.
