The present work aims to investigate the use of foreing judicial precedent, by the Brazilian Supreme Court, in two of the main judicial decisions about abortion, which are, the ADPF 54 (therapeutic anticipation of childbirth) e o habeas corpus 124.306/RJ (decriminalization of voluntary termination of pregnancy in the first trimester). As a methodological procedure, bibliographical, legislative, doctrine and jurisprudential revision was used, in particular by consulting books and scientific journals.
