Buscou-se identificar convergências e conflitos no estabelecimento da relação obrigacional entre Estado e investidor estrangeiro no que concerne à atração e ao avanço de políticas regulatórias. Foram aspectos centrais da pesquisa: o contexto de transformações globais relativo ao investimento externo e o conteúdo obrigacional de instrumentos ratificados entre nações parceiras. A pesquisa caracterizou-se como qualitativa, de método dedutivo e técnica descritiva, com recurso à análise bibliográfica. Concluiu-se pela necessária revisão do regime internacional para modificar o conteúdo obrigacional dos acordos de investimento, reforçando o direito regulatório quando não direcionado a fins protecionistas.
