Este artigo traça reflexões quanto à instituição e majoração dos tributos no Brasil por ato do poder executivo, à luz da crise da lei. A crise da lei foi analisada por Jaques Chevallier e a sua obra é tomada como marco teórico. Foi realizada uma pesquisa bibliográfica para responder ao seguinte questionamento: a incursão do poder Executivo na instituição e majoração dos tributos pode ser entendida como consequência da crise da legalidade no estado pós-moderno?
