Intersexuality is not only a biomedical issue, it also involves issues that require the attention of the social and legal sciences, as their reflexes cross individual boundaries and reach the social and legal realm. Because they have characteristics related to both sexes, the smallest intersex is marginalized by the legal system. Thus, the present article seeks, through a bibliographic survey, to present the smallest intersex, to address the need for the judiciary to answer the issue, to analyze as opposed to the rights of the child's personality.
