This article presents the doctrinal discussion related to the hermeneutic issues inherent to the votes of the STF Ministers regarding ADI no 4277 and ADPF 132, as well as the social repercussion of Resolution no 175, of the CNJ, compared with the data of the last survey of the IBGE regarding same-sex marriages carried out due to such judicial decisions. It uses bibliographic and jurisprudential research as a working method, devoting itself to analyzing the complexity of the relationship between legislative omission, social dynamics and judges' decisions, focusing on the concepts of decisionism, protagonism and/or judicial activism.
