This study aims to discuss the rights of persons with disabilities, their legal treatment, and among them, the right to education as an indispensable measure for the development of people with disabilities, how can be provide in an inclusive way, in the regular schools, problematizing affirmative actions as an instrument capable of effecting rights, mainly, to equal access in the educational system to persons with disabilities. For that, the methodology adopted is eminently theoretical and doctrinaire, using briefly Rawls and his Theory of Justice as justification in the adoption of affirmative actions in the social right to education.
