This paper discuss the recent decision of the Federal Court of Justice regarding the State's liability to indemnify a prisoner subject to a degrading condition within the prison system. The theme gains relevance in the context of the security crisis faced by Brazilian society. There is a "culture of fear" where groups stigmatize and dehumanize detainees, understanding that they do not have rights because they have chosen the "life‟s crime ". Our reflection has two points: the dilemma between public security and human rights and how the international and national protection‟s systems of human rights based the judicial decision.
