This study addresses current STF directives related to SUS provision of unregistered medications for rare and ultra-rare diseases. To this end, it addresses the right to health, its relativization and judicialization; lists the rules employed by ANVISA for the supply of medicines; and presents the decisions of the Supreme Court on the subject. In conclusion, it is clear that the Supreme Court has made progress in ensuring the provision of unregistered medicines for rare and ultra-rare diseases, provided that their use is the only alternative to the patient's life, in order to make the fundamental right to health effective.
