This work’s objective is to analyze relevant aspects of the Superior Court of Justice’s judgment in the file of Special Appeal 1.757.775-SP, as a result of judicial activism, which has been establishing a revolutionary and progressive jurisprudence regarding fundamental rights, especially in the Legislative and Executive’s absence. The function of the Superior Court is to resolve the controversy and legislative lapse, using constitutional precepts in the law’s interpretation and application to the specific case. It analyzes whether the solution given to the controversy meets the spirit of the legislation and the fundamental rights of women who are victims of violence.
