The article criticizes the lack of care constituent assemblies display when designing institutions from the perspective of the principles of efficiency and efficacy of public expenditure. It identifies the phenomenon consisting on the expansion of special judicial remedies for constitutional rights in Ecuador as a process of fragmentation of the legal discourse concerning the relationship Citizen-State –which is also the object matter of administrative jurisdiction–. Finally, it explores the negative consequences of the phenomenon of redundancy in terms of the economic resources that are available for the State and the citizens.
