The policy on the implementation of the Law on execution of criminal judgments (PILECJ) is an area of criminal policy that has an important role in preventing and fighting crimes as well as in actualizing the criminal liability of legal entities and natural persons committing crimes. Studying PILECJ, therefore, is an urgent requirement in the current period of the national development, international integration and judicial reform. Nevertheless, compared to the studies in criminal, criminal procedure and crime prevention fields, the study of PILECJ has not yet met both theoretical and practical requirements. To contribute to the improving of this situation, this paper clarifies a number of theoretical issues related to PILECJ, aiming at answering the following questions: (i) What is the current situation of research on PILECJ in Vietnam? (ii) What are the definition, nature and characteristics of PILECJ? (iii) How should PILECJ be developed? (iv) What issues need to be included in PILECJ? (v) What is the relationship between PILECJ and its development and implementation? To answer these questions, the paper uses methods of analysis, comparison and synthesis under the foundation of the dialectical method and the human rightsbased approach to put research issues in connection with growth and development on the basis of respecting, guaranteeing, and protecting human rights in execution of criminal judgments.
