Along with the development of increasingly advanced technology, many businessmen who take advantage of this opportunity to run its business. Like Go-Jek, which implements a motorcycle taxi system by ordering services online. Go-Jek implements a share-sharing system and partnership agreement with Go-Jek's driver. The purpose of this study is to understand the system of profit sharing applied by Go-Jek companies in the view of Islamic law and positive law. This study uses qualitative research methods that generate descriptive data to describe a state of profit sharing system implemented by Go-Jek company. Furthermore, it is analyzed using an inductive mindset by explaining the facts that occur in the field which is then associated with the theory of Islamic profit-sharing system and the Law on cooperation contracts. From the research it can be concluded that the profit-sharing system implemented by Go-Jek company has been in accordance with the system of Islamic profit sharing and cooperation made between the two parties has been in accordance with the system ofcooperation of Islami. Judging from the Law on Employment Agreements Articles 52 and 54 of Law No.13 / 2003, and Article 1320 of the Civil Code the contract of Go-Jek cooperation agreement has also been appropriate. ABSTRAK Seiring dengan perkembangan teknologi yang semakin maju, banyak pebisnis yang memanfaatkan peluang ini untuk menjalankan usahanya. Seperti halnya Go-Jek, yang menerapkan sistem ojek dengan pemesanan layanan secara online. Go-Jek menerapkan sistem bagi hasil dan perjanjian kerjasama kemitraan kepada sopir Go-Jek. Tujuan penelitian ini adalah untuk memahami sistem bagi hasil yang diterapkan perusahaan Go-Jek dalam pandangan hukum Islam dan hukum positif.Penelitian ini menggunakan metode penelitian kualitatif yang menghasilkan data deskriptif untuk menggambarkan suatu keadaan tentang sistem bagi hasil yang diterapkan oleh perusahaan Go-Jek. Selanjutnya, dianalisis menggunakan pola pikir induktif dengan menjelaskan kenyataan-kenyataan yang terjadi di lapangan yang kemudian dihubungkan dengan teori sistem bagi hasil secara Islami dan Undang-undang tentang kontrak kerjasama. Dari penelitian dapat disimpulkan bahwa sistem bagi hasil yang diterapkan oleh perusahaan Go-Jek telah sesuai dengan sistem bagi hasil secara Islami dan kerjasama yang dilakukan antara kedua belah pihak telah sesuai dengan sistem kerjasama musyarakah yang Islami. Dilihat dari Undang-undang tentang perjanjian kerja pasal 52 dan 54 UU No.13/2003, dan pasal 1320 KUH Perdata kontrak perjanjian kerjasama Go-Jek juga telah sesuai.
