O DEVER DE DEIXAR SEM EFEITO OS CONTRATOS AFETADOS POR ATOS DE CORRUPCAO THE DUTY TO RENDER INEFFECTIVE THE CONTRACTS AFFECTED BY ACTS OF CORRUPTION Carlos Aymerich Cano* RESUMO: A obrigacao de anular ou resolver os contratos publicos afetados por crimes de corrupcao, embora reconhecida no papel, segue a ser uma materia pendente nos ordenamentos espanhol e europeu. O presente trabalho analisa as questoes que levantam os escassos acordaos ditados pela jurisdicao criminal anulando estes atos e contratos, apontando as potencialidades de figura do confisco. ABSTRACT: The duty to annul or end public contracts affected by crimes of corruption, although recognized on paper, keeps being a pending issue in Spanish and European legal systems. The present work analyzes the issues that raise the few judgments rendered by the criminal jurisdiction holding these acts and contracts null, pointing out to the potential of the confiscation figure.
