Causal relationship as a link between the offence (act or failure to act) and the following (in terms of time) harmful consequences is the confirmed feature of material criminal offences’ corpus delicti. Nevertheless, causal relationship can have a significance also in cases when legislator has included in the Criminal Law regulations, indicating evaluation of harm caused, for example, the Criminal Law Section 46 paragraph 2, where the harm caused has to be taken into account in determination of penalty, as well as Section 58, paragraph 1, where the harm caused has to be taken into account in release from punishment during evaluation that aspires to determine whether the criminal offence has not caused harm that would warrant the application of a criminal penalty. The article draws attention to the evaluation of caused harm in substantiation for determining the type of punishment and release from punishment.
