One of the greatest challenges of anti-discrimination law is institutionalized inequality.  Recognized in law as systemic discrimination, it is embedded in processes, practices, norms, and relationships that reproduce and accentuate inequality.  Legal recognition of the phenomenon, though of critical importance, has not led to effective remedies.  Retroactive individual remedies are often too little, too late, following years of slow-moving and difficult litigation. Systemic, proactive laws have been thwarted by institutional resistance to externally imposed change and/or captured by the power of the institutional status quo.  This paper explores the challenges of institutional transformation using the idea of courage – the experience of discouragement, encouragement by institutional change-makers, and the power of solidarity to encourage change from the bottom up. L’inegalite institutionnalisee est l’un des plus grands defis de la legislation antidiscrimination. Reconnue en droit en tant que discrimination systemique, elle fait partie integrante des processus, pratiques, normes et rapports qui reproduisent et accentuent l’inegalite.  Bien que la reconnaissance juridique du phenomene soit d’une importance critique, elle n’a pas mene a des recours efficaces. Les recours individuels retroactifs sont souvent inadequats et trop tardifs et ne sont accordes qu’apres des annees de litiges lents et ardus. Des lois systemiques et proactives ont ete contrecarrees par la resistance institutionnelle au changement impose de l’exterieur ou defaites par le pouvoir du statu quo institutionnel. Le present article examine les defis de la transformation institutionnelle en utilisant l’idee du courage – l’experience du decouragement, l’encouragement par les agents institutionnels du changement, ainsi que le pouvoir de la solidarite pour encourager le changement de bas en haut.
