espanol?Quien es el mejor razonador moral? ?El juez o el legislador? El proposito de este trabajo es refinar esta pregunta distinguiendo entre diferentes asunciones metaeticas. Si las asunciones metaeticas de los que construyen argumentos morales son incompatibles o si su objetivo institucional consiste en establecer algun tipo de verdad, de ninguna forma podra generarse una actividad argumentativa constructiva. Mi tesis es que solo cuando se renuncia a toda pretension epistemica y se desarrolla empatia respecto de los argumentos de los demas, pueden las instituciones mejorar la calidad de sus argumentos tanto judiciales como democraticos, y por consiguiente incrementar su autoridad. EnglishWho is the best moral reasoner, the judge or the legislator? The aim of this paper is to refine this question, by distinguishing between different metaethical assumptions. If the meta-ethical assumptions of arguers are incompatible or if their institutional goal is to establish some truth, there is no way of entering in a constructive argumentative activity. My claim is that only when arguers renounce any epistemic temptation and feel empathy with respect to others’ arguments, can institutions improve the quality of their judicial and democratic arguments, and therefore gain authority.
