The due process of law is inherent to the Democratic State of Law, being that its creation has come after the overcoming of positivism. The absence or even the lack of the substantiation involves, or should, the nullity of the juridical act by the absence of the due process of law. The sentence is responsible for transcribe to the eyes of society if the judicial process attended the dictates of the due process of law and if has been concretized the right of access to justice, in other words, if the contradictory, the publicity and the substantiation have been contemplated by the judge having the elements of the paradigmatic decision as reference.
