Cuida-se de analisar as implicacoes da Lei n. 10.216/01, alcunhada por Lei da Reforma Psiquiatrica, no que se refere ao tratamento despendido ao louco infrator. Por conseguinte, evidenciar a problematica da aplicabilidade da politica de saude mental face ao pranteado modelo juridico-terapeutico-punitivo-prisional dos Hospitais de Custodia e Tratamento Penitenciarios (HCTPs). Neste raciocinio, se mostra evidente o conflito aos direitos humanos em face ao diploma legal em comento, por nao se coadunarem com o sistema de justica criminal brasileiro, sendo este ineficaz no tratamento do portador de transtorno mental que comete crime, em especial nos casos de psicopatia. Abstract Take care to analyze the implications of the Law 10.216/01, nicknamed by the Psychiatric Reform Law, as when handling the insane offender spent.
