El articulo tiene como objetivo hacer una exposicion de la “teoria material del bien juridico”, elaborada por el penalista Juan Bustos Ramirez, y en colaboracion con el penalista Hernan Hormazabal Malaree. En la primera parte del presente trabajo, se efectua una descripcion bibliografica de tipo lineal, de las contribuciones de cada autor a la teoria. En una segunda parte, se analizan los que se entiende como elementos fundamentales de dicha teoria, senalando la ontogenesis de los conceptos que forman el sistema, y examinandolos teorica y metodologicamente en su nivel de aportacion a la teoria.
