In the context of compliance with the World Health Organization Framework Convention on Tobacco Control, Australia was the first country in the world to implement, in December 2012, legislation on Tobacco Plain Packaging (TPP).Through this research, we will analyze what could happen in Peru if eventually a TPP legislation is adopted, using the perspective of the Test of Proportionality applied by the Peruvian Constitutional Court.This study has been divided into three sections: constitutional rights involved in the TPP restriction; characteristics of the TPP legislation; and the analysis of the TPP under the Test of Proportionality.
