Аннотация: существование судебной власти наряду с законодательной и исполнительной является важным признаком демократического государства. Обособление судебной власти от иных государственно-властных структур свидетельствует о продвижении государства к реализации принципа верховенства права, закрепленных в нем идей свободы и справедливости. Понимание того, что концентрация власти в одних руках ведет к произволу, что разные направления государственной власти необходимо разделять, возникло давно. Судебный контроль будет способствовать повышению эффективности, быстроты досудебного производства. Статья посвящена рассмотрению вопросов осуществления судом контроля за законностью и обоснованностью избрания и применения меры пресечения в виде заключения под стражу. Abstract: the existence of the judiciary along with legislative and executive power are the important signs of a democratic state. Isolation of the judiciary from other public authorities suggests the promotion of a state towards implementation of the rule of law and highlighted in it ideas of freedom and justice. Understanding of that that concentration of power in one’s hands brings to arbitrariness, and that different directions of state power must be separated, occurred a long time ago. Judicial review will enhance the efficiency and will accelerate pre-trial proceedings. The article discusses the issues of judicial review over the legality and validity of the selection and the application of a preventive measure in the form of detention.
