Resumen: Las contradicciones que el desarrollo de las tecnicas de reproduccion asistida provocan sobre los ordenamientos juridicos tienen en la gestacion subrogada su maximo exponente. A la mater­nidad tecnologica no la ha acompanado una adecuada regulacion juridica, lo que ha provocado que los tribunales y la DGRN convivan en una dualidad que provoca irremediablemente la perdida del interes superior del menor. Tras cerrar las puertas a la inscripcion de la filiacion de menores nacidos por ges­tacion subrogada, el TS apunto a la adopcion como modo de proteger los intereses de los menores. Sin embargo, recientes decisiones judiciales no parecen indicar que ese sea el camino ni mas rapido ni mas adecuado. Por tanto, hemos revisado diferentes planteamientos que el TS ha aceptado en temas analogos buscando una justificacion o salida a estas situaciones. El reconocimiento por complacencia o el orden publico atenuado son algunas de las opciones que se exploran ante la negativa actual de afrontar la de­manda social de una regulacion justa y adecuada para todos los afectados. Abstract: The contradictions that the development of assisted reproduction techniques provoke in the legal systems have in the surrogacy its maximum exponent. Technological maternity has not been accompanied by adequate legal regulation, which has caused the Courts and the DGRN to coexist in a duality that irremediably causes the loss of the best interests of the child. After closing the doors to the registration of the filiation of minors born through surrogacy, the Supreme Court pointed to adoption as a way to protect the interests of minors. However, recent court decisions do not seem to indicate that this is the fastest or most appropriate course of action. Therefore, we have reviewed different approaches that the SC has accepted in analogous issues seeking a justification or a way out of these situations. Re­cognition out of complacency or attenuated public order are some of the options explored in view of the current refusal to face the social demand for a fair and adequate regulation for all those affected.
