42 Аннотация. В статье автор исследует проблемные вопросы начала действия принципа презумпции невиновности. Критически оценены существующие в настоящее время положения о возникновении права на защиту от необоснованного утверждения виновности в совершении преступления с момента возбуждения уголовного дела. Обосновывается подход о начале действия этого принципа со времени, когда фактически стало осуществляться уголовное преследование. The author explores the problematic issues of the beginning of the principle of presumption of innocence. Critically evaluate the currently existing position of the origin of the right to protection against unjustified allegations guilty to the crime since the initiation of criminal proceedings.
