The present work tries to observe the legitimacy of the judicial review in times of political crisis. We reflect on the birth of judicial review as a paradox and the problematic discussed about its legitimacy. In times of political crisis, the political subsystem causes systemic irritations, bringing forth new semantics that judicial review must transform into legal communications. We identify judicial populism and the primacy of economic arguments as new elements that provoke crisis in the democratic legitimacy of judicial review.
