Resumo : Neste artigo procurar-se-a fazer uma reflexao sob a otica constitucional-civil sobre: a) o direito a ser esquecido como um direito fundamental, como um direito da personalidade e como paradigma da privacidade historica; b) a dignidade da pessoa humana como ponto central do direito a ser esquecido; c) a ideia de que a ofensa ao direito a ser esquecido e uma afronta a vida digna, que e um bem precioso, que se sobrepoe a todos. Palavras chaves : direito a ser esquecido – direito fundamental – direito da personalidade – dignidade humana – minimo existencial - privacidade historica. Abstract : In this article we intent to reflect on the constitutional-civil perspective about: a) the right to be forgotten as a fundamental right, as a right of the personality and as a paradigm of historical privacy; B) the dignity of the human person as the central point of the right to be forgotten; C) the idea that the offense to the right to be forgotten is an affront to the dignified life, which is a precious asset, which overcomes all the others.
