The appearance of an own or individual State responsibility is a recent phenomenon in the evolution of legal discipline that only appears at the end of the XIX century. The objective of this article is to present and analyze the origin and general evolution of the different theories and juridical -political focuses that from the theses of civil law permitted the consolidation of a special and autonomous type of responsibility within Public Law and especially in Administrative Law. It is a socio - legal research project with an explanatory and historical study that at the time uses the dialectic method on the changes during the course of time; both primary and secondary sources are used especially written documents.
