The implementation of Urban Policy in Brazil has as its main tool the Management Plan and must count, obligatorily, on the direct participation of citizens. The Precautionary Principle requires the adoption of measures that aim to prevent the occurrence of damage to those who try to repair what has already been damaged. This paper aims, through legal and bibliographic research, to demonstrate the obstacles that have focused on the realization of what was determined by the Precautionary Principle, given the fact of constitutionally granting the municipality with less than twenty thousand inhabitants the right to have or not the Management Plan.
