espanolLa Corte Constitucional colombiana declaro en 1988 que las condiciones de sus carceles se encontraban en un “estado de cosas inconstitucionales”. Con esta declaracion la Corte, pretendia, no solo llamar la atencion sobre sus condiciones, sino tomar las riendas para la superacion de esta situacion, ordenando aquello que debia realizarse. Posteriormente, en 2013 y 2015 sostuvo que, a pesar de los esfuerzos realizados, la situacion era estructural y permanente. Esto significa que en Colombia se violan sistematicamente los derechos fundamentales y la dignidad de las personas presas, estando sometidos a condiciones crueles, inhumanas y degradantes. En 2018 la Corte continua dando ordenes para superar esta situacion. El articulo analiza de que forma, las sentencias de la Corte, paradojicamente han contribuido a que esta situacion se perpetue en el tiempo, reconfigurando el sistema punitivo colombiano, incorporando penas (fosos y mazmorras) ajenas a la legalidad. EnglishThe Colombian Constitutional Court declared 1988 that the conditions of its prisons were in a "state of unconstitutionality". With this declaration, the Court intended, not only to draw attention to its conditions, but to take the reins to overcome this situation, ordering what should be done. Later, in 2013 and 2015, he maintained that, despite the efforts made, the situation was structural and permanent. This meant that in Colombia the fundamental rights and dignity of prisoners were systematically violated, being subjected to cruel, inhuman and degrading conditions. By 2018, the Court continues to issue orders to overcome this situation. The article analyzes how the sentences of the Court, paradoxically have contributed to this situation is perpetuated over time, reconfiguring the Colombian punitive system, incorporating penalties (pit and dungeon) outside the law.
