espanolEste trabajo tiene por objeto el analisis de la regla de litispendencia intracomunitaria del art. 19 del Reglamento (CE) 2201/2003 en relacion exclusivamente a los procesos paralelos de separacion judicial, divorcio y nulidad matrimonial. Teniendo en cuenta la futura aplicacion del Reglamento (UE) 2019/1111, que sustituira al Reglamento (CE) 2201/2003, se examina la naturaleza rigida de esta regla, valorando las posibilidades de flexibilizacion del prior tempore con especial referencia a la figura del forum non conveniens en materia matrimonial. Asimismo, la cuestion de la identidad de partes, objeto y causa en los procesos paralelos matrimoniales, prestando especial atencion a las acciones dependientes y a los desajustes que una aproximacion que equipara las instituciones de la separacion judicial, el divorcio y la nulidad matrimonial, puede generar respecto de los objetivos del Reglamento 2201/2003. Determinado el momento de inicio de los procesos matrimoniales a efectos de litispendencia, especialmente, la influencia de eventuales fases previas obligatorias de conciliacion entre conyuges, se estudia el comportamiento procesal exigido por la norma al primer y segundo organo jurisdiccional, dedicando un epigrafe a la posibilidad de transferencia de acciones paralelas, de problematica importante y de dificil respuesta, sobre todo en cuanto a los aspectos conflictuales relativos a la accion trasvasada, terminando con una referencia a la relacion existente entre litispendencia intracomunitaria y divorcio notarial espanol. EnglishThis work analyses the EU lis pendens rule of art. 19 of Regulation (EC) 2201/2003 in relation exclusively to the parallel proceedings of legal separation, divorce and marriage annulment. Taking into account the future application of Regulation (EU) 2019/1111, repealing Regulation (EC) 2201/2003, the rigid nature of this rule is examined, valuing the flexibility possibilities of the prior tempore with special reference to the forum non conveniens in matrimonial matters. Likewise, the question of the identity of parties and cause of action in parallel matrimonial proceedings, paying special attention to the dependent actions and to the consequences for the goals of Regulation (EC) 2201/2003 derived from the equal weight given to legal separation, divorce and marriage annulment. Determined the seising of a EU matrimonial court for lis pendens, specially, mandatory attemps for matrimonial reconciliation, the procedural exigences of the rule for the first and second seised court are studied, dedicating a section to the possibility and problems of transfer of parallel actions, especially with respect to the choice of law rule related to the action transferred, ending with a reference to the relationship between EU lis pendens and Spanish notarial divorce.
