espanolLas catastrofes ambientales registradas en el ultimo siglo y los efectos nocivos que la actividad industrial y nuestra forma de vida tienen sobre el medio ambiente y, con el, sobre nuestra calidad de vida, han puesto de manifiesto la especial naturaleza de los danos ambientales, su magnitud y los retos juridicos que su complejidad plantea, directamente relacionados con los que la globalizacion o mundializacion plantea al Derecho en general y al Derecho internacional privado en particular. Las acciones colectivas se revelan como un instrumento valioso en el acceso a la justicia por parte de los perjudicados por danos ambientales en los que frecuentemente concurre algun elemento internacional. Sin embargo, su aun incipiente regulacion, especialmente en materia ambiental, impide o dificulta su empleo, con el conscuente efecto negativo en terminos de reparacion de los danos, individuales y sociales, por parte de los presuntos responsables. Se analizan pues estos obstaculos con el fin de formular algunas propuestas de mejora de las acciones colectivas tanto a nivel nacional espanol como supranacional de la Union Europea. EnglishEnvironmental disasters occurred over the last century and the harmful effects that the industrial activity and our lifestyle have on the environment and, therefore, on our quality of life have broght to light the special and complex nature of environmental damages. These damages pose several challenges to Law in general and to Private international law in particular, as the presence of a foreign element is increasingly common in these cases. In this scenario, collective redress mechanisms appear as a useful tool to access efective justice for injured people. However, its deficient and incipient regulation, especially as regards environmental matters, makes its use difficult or impossible which results in an insufficient or inexistent repair of the damages, both the individual and the social ones. These obstacles will be analyzed in this work in order to make some proposals with the aim of improving both the Spanish and the European regulation of collective redress mechanisms.
