Resumen Un fenomeno complejo y sistematico como lo es el delito, presenta en cada uno de los escenarios que lo componen una serie de problemas juridicos que tiene repercusiones en la libertad del ciudadano. Es por ello que resulta me- nesteroso precisar cual es la postura politico criminal del Estado colombiano a cada una de esas preguntas problema. Necesitandose por ende, inferir cuales son las soluciones dogmaticas contenidas en la Ley 599 de 2000 producto de esa politica criminal. Entendiendose que al determinar esa necesidad de construir un marco teorico como cierto, se reitera de inmediato lo ya sabido: que el Derecho Penal como ciencia, es decir como dogmatica, al igual que la prueba son herramientas imprescindibles en un proceso penal. Abstract A complex and systematic phenomenon as the crime. The crime compose legal problems damage and harm the liberty of the citizen. It's therefore is needy and difficult identify criminal policy position or ideology of the Colombian State to each one problems questions. In this moments is important infer the answer dogmatic in Law 599 of 2000, result of criminal policy and to find the need to build a theoretical framework as some, it's reiterative what is know: Criminal Law as a science, in other words as dogmatic, as proof are essential in the criminal process
