Los casos de Hugo Chavez, en Venezuela, y de Rafael Correa, en Ecuador, han evidenciado una nueva problematica frente a la eleccion de lideres de America Latina, pues se demuestra el uso del carisma como mecanismo para malear el derecho que irradia todo el sistema juridico desde el mismo proceso constituyente. Asi, mediante el uso del analisis del discurso, la historia del derecho y el derecho comparado, el presente articulo se propone dar luces sobre si el carisma del lider afecta el ordenamiento juridico y si los intereses del electorado se ven confundidos por los del lider o, por el contrario, si dichos procesos son la expresion del constituyente primario. Tambien evidencia que la relacion del carisma y el derecho es comun a la misma naturaleza del ser humano; por tanto, los procesos no son de una sola causa sino que se complementan unos a otros. Por ultimo, se recalca la importancia de la identificacion de los factores que afectan al derecho, buscando abandonar el enclaustramiento de lo juridico y abrir paso a otros factores que lo complementan. Abstract Cases of Hugo Chavez in Venezuela and Rafael Correa in Ecuador, have shown a new problem facing the choice of leaders from Latin America: the possibility of change the right, through the use of charisma, it is shown radiating from the entire legal system the same constituent process; through the use of discourse analysis, the history of law and comparative law, this article aims to shed light on whether the charisma front, headed by the leaders, affect the law and whether the interests of the electorate are confused by the leader or otherwise, such processes are the expression of the primary constituent; Also evidence that the relationship of the charism and the right to it is common human nature, so the process is not a single cause but will complement each other; this delivery want to emphasize the importance of identifying factors affecting the right, to thereby leave the enclosure of the legal and other factors make their way to complement it.
