El presente trabajo constituye un analisis critico de la realidad social y legal compartida en la mayoria de los paises latinoamericanos desde la perspectiva de un concepto literario como lo es el realismo magico y con un enfoque filosofico representado en el realismo juridico. La mezcla y satirizacion de ambos conceptos da lugar a un nuevo constructo: el realismo magico juridico, el cual, en sintesis, representa la critica de la separacion cotidiana de la realidad normativa y la realidad social. Abstract This essay is a critical analysis of the social and legal reality shared in most Latin American countries, from the perspective of a concept and literary trend as is the magical realism and a philosophical approach represented in the legal realism. The mixture and satire of both concepts gives rise to a new construct: the legal magical realism, which in essence represents the critique of daily separation of normative reality and social reality.
