Negotiorum gestio is an important issue of Law of Obligations special provisions in which settled between the Articles 526 – 531 in the Part 10 of Turkish Code of Obligations numbered 6098, can be defined as a spontaneous agency in which the gestor, acts on behalf and for the benefit of a principal, but without his or her consent, Legal status of gestor in the negotiorum gestio differs according to negotiorum gestio which splits into two types as a virtual negotiorum gestio and a non-virtual negotiorum gestio. Virtual gestor hast to act for the benefit of a principal and suitable for the virtual or assumed purpose of him. Whilst, legal status of virtual gestor in which settled between the Articles 526-528 in Code of Obligations under the headings of “fullfilling”, “liability” and “incapacity of gestor”; legal status of non-virtual gestor is settled in the Article 530 which rules differently.
