A Constituição de 1988, ao estabelecer pela primeira vez que os deveres e responsabilidades decorrentes da sociedade conjugal cabem igualmente a ambos os cônjuges, marcou a mudança de paradigma do Direito do Trabalho que, antes, destinava-se a proteger o lugar da mulher no lar e agora se destina a garantir a possibilidade efetiva de trabalhar. O artigo pretende resgatar as facetas da ideologia patriarcal que regia a estrutura jurídica anterior para valorizar a conquista histórica que tal ruptura representou. A idéia é promover conscientização acerca desta conquista, para preservá-la e permitir avanços quanto à condição jurídica e social da mulher. The Constitution of 1988 represents a paradigm shift of Labour Laws that previously protected women only in their homes, and nowadays intend to guarantee the possibility of regular jobs. The article shows the patriarchal ideology that presided the laws before the 80's and stresses the historical victory that this break represented. The idea is to promote consciousness about this victory, that it be remembered and continue to provide new advances in the social and legal condition of women
