Pegas e, provavelmente, um dos melhores exemplos, no que se refere a America Portuguesa, do emaranhado em que se encontravam ordens juridicas gerais e particulares, doutrina juridica e decisoes de tribunais. A partir dessa obra, serao discutias as relacoes entre o ius commune e o espaco juridico do Brasil Colonial, o qual nao pode ser encarado se fosse apartado de uma ordem juridica geral. Pegas’  Allegation on the succession of the Captaincy of Pernambuco (1671) probably is one of the best examples of the entanglements among general and particular juridical orders, legal doctrine and courts’ decisions during the Early Modern in Portuguese America. From that book, this paper will discuss the relations among ius commune and the juridical space of Colonial Brazil, which cannot be seen as something apart of the general order.
