. Study of creation of the organization as part of the life cycle of an economic entity in the legal literature is now being given enough attention. However, the establishment of a legal form of legal entity is a very special organization and order of its creation is different from the most common regulatory recruiting process. To address issues of local importance, in some cases requires a special entity an organization with a special personality. To implement statutory activities organization – an institution endowed with the property on a limited real right operational management. The purpose of research is to reveal the mechanism of creation of municipal budgetary institutions. Methods. The author used in combination the methods of scientific knowledge, including basic – methods of formal-legal, system, analysis, synthesis and comparative law. Results. It is proved that the procedure for the establishment of municipal budgetary institutions involves several structural units of the local government or several local governments. The law defines the procedure for the creation of the study of the legal form of legal entity includes acts not only at the federal level, but also the regulations of local governments. Conclusions. The creation of municipal budgetary institution assumes the publication of the corresponding municipal legal act of creation, the act of approval of the charter, the act of conferring the property for operational management. However, this organization should be considered as created as a legal entity only upon making the relevant record of the state registration in the Unified State Register of Legal Entities, and from that moment it acquires the civil legal standing.
