Objective. To adress the legal implications related to the individual publication of transfers of value from Pharmaceutical Companies to Healthcare professionals, detailing the negative consequences that may result for the right to health protection, motivated by the risk that leads to the survival of collaboration between the pharmaceutical industry and healthcare professionals. Method. Analysis of the regulations applicable in fiscal, privacy Law and Law of incompatibilities, reports and opinions issued on the matter, and statements of the sectors involved, both the pharmaceutical industry as well as the medical professionals and the Government. Results. The study concludes that the individual publication of transfers of value from Pharmaceutical Companies to Healthcare professionals can lead to a breach of the rules on privacy and to be contrary to the spirit of the European Regulation that comes into force in 2018. It also supposes a contradiction with the legal frame of incompatibilities. Finally, the tax control that is intended to be carried out using such information is not in accordance with our Law, by extending a tax duty through a different route to the adoption of a Law. Conclusion. There is a need for a harmonization of legislation that finish the uncertainty arising from the publication of publication of transfers of value and to prevent the survival of the historic and necessary collaboration between the pharmaceutical industry and health professionals, which is a fundamental pillar which establishes the development and the essential research to guarantee the right to health protection.
