Este articulo presenta como en el Art. 270 del Codigo Penal Italiano la asociacion subversiva de personas, con el proposito de alterar o interrumpir violentamente la situacion economica y social constituye un delito visto a la luz de lo sucedido con el fascismo. Se expone la siguiente revision: el delito de asociacion subversiva: caracteristicas generales del caso; La genesis del delito de asociacion subversiva y su relacion con el delito politico; el problema de la validez del articulo 270 del Codigo Penal despues d el final del regimen fascista; las preguntas de la  constitucionalidad del delito de asociacion subversiva; la relacion entre el articulo 270 del Codigo Penal y el articulo 270 siguientes; los problemas politico-juridicos del articulo en ajuste al 270 del Codigo Penal y, en general, la categoria de delito politico, y los sistemas democraticos de los proyectos de reforma. Y se finaliza con algunas observaciones en las que se concluye que es necesaria una nueva legislacion porque no hay legitimidad del Estado democratico por lo que la jurisprudencia ha insistido en la legalidad haciendo una interpretacion a manera de evolucion. Abstract This article and Article 270 of the Italian Penal Code subversive association of persons for the purpose of altering or violently disrupt the economic and social situation is a crime seen in the light of what happened to Fascism. It exposes the following revision: The crime of subversive association: general characteristics of the case, The genesis of the crime of subversive association and its relation to political crimes; The problem of the validity of Article 270 of the Penal Code after the end of the fascist regime; The questions of the constitutionality of the crime of subversive association; The relationship between Article 270 of the Penal Code and Article 270 ff; political and legal problems of adjustment to article 270 of the Penal Code and in general, the category of political crime and democratic process of reform projects. And ending with some comments which concludes that new legislation is needed because there is no democratic legitimacy of the state so the law has insisted on the legality of making an interpretation by way of evolution.
